CONSTITUTION OF THE
SOVEREIGN IMPERIAL KINGDOM OF NATOPIA
Preamble
We, the grand and noble royalty and other persons of high importance, do hereby establish and ordain this Constitution of the Sovereign Imperial Kingdom of Natopia, so the people of Natopia may prosper, live peacefully, live in Silent Oppression, so they may protect and envision their ideals and dreams, so they may provide stability for posterity.
Article One
1. The Natopian Citizens hereby grant their personal sovereignty to this government.
2. This government shall be named the Sovereign Imperial Kingdom of Natopia.
3. The government will act to preserve the Constitution and the rights of its citizens.
Article Two
1. His or Her Sovereign Majesty, the Sovereign Natopian King or Queen, shall serve as head of state until such time as he abdicates, dies, or is otherwise incapacitated due to reasons of health or inactivity.
2. The Sovereign Natopian King or Queen shall appoint a Regent who will inherit the throne at this time and may change this regent at will.
3. Should the King or Queen take an official leave of absence as shall be posted in Vista de Nada Palace within the official Sovereign Natopian Forums, the regent shall reign during this leave of absence but must relinquish this duty upon the King or Queen’s return.
4. Should the King or Queen be inactive for a period of ten (10) or more days the Regent shall reign until the King or Queen’s activity is reassumed.
5. Should the King or Queen be inactive for a period of ninety-three (93) days he or she shall be considered incapacitated and the Regent shall be coronated as King or Queen.
6. Should the King or Queen suffer traumatic heath-related trauma beyond repair the Regent shall be coronated as King or Queen.
7. Should there be any dispute regarding this the Royal Frenzy (to be described later) shall decide whether or not the trauma is irreparable and if three fifths (3/5) of the voting members decide this trauma is irreparable at any given time power shall be transferred; however if this decision proves false and the former King or Queen wishes to regain their throne they may, and the Royal Frenzy shall be required to issue a statement of apology to the Regent as well as the People of Natopia and may be held financially accountable as prescribed by law.
8. The King or Queen has the ability to issue Royal Decrees. These Decrees shall have the force of law.
9. The King or Queen has the ability to create Ministries which will be totally managed by him or her in order to govern day-to-day governmental activities.
10. The King or Queen shall appoint a Prime Minister who will be third in line for the crown and may change this Prime Minister at will. Should there be no regent for a particular King or Queen capable of ruling the Prime Minister shall be third in line toward the throne. The Prime Minister shall serve to manage the Ministries to ensure that they stay within their power and are beneficial and shall report to the King. Should a Regent advance toward the throne the Prime Minister shall take on the duties but not the title of Regent until the new King or Queen says otherwise.
Article Three
1. The Royal Frenzy shall serve as the legislature of the Kingdom.
2. The Royal Frenzy shall consist of all active citizens who have been citizens of the Empire for no less than three (3) months.
3. The Royal Frenzy shall elect a Chancellor every eight (8) months.
4. The Chancellor shall have the authority to manage the Royal Frenzy and will ensure adherence to Frenzy procedures. Should there be no Chancellor the Prime Minister shall serve as Chancellor until a new Chancellor can be elected.
5. Should the Royal Frenzy feel that the Chancellor is acting out of order or not fulfilling his or her duties they may remove him or her by a vote of at least two thirds (2/3) in approval of removal. The Chancellor may not try to stifle any such vote and if he or she does the King or Queen may step in to ensure this does not happen by possibly removing the Chancellor’s power, his or her forum power, or doing other things necessary to ensure the good of the people.
6. The Royal Frenzy shall establish its own procedures and rules.
7. The Royal Frenzy may make any act it feels is for the good of the people. In order for such acts to take effect a majority of the members who vote on an issue must approve the act. They may be repealed with other laws, similarly like the Decree.
8. A Decree made by the King or Queen may be repealed by the Royal Frenzy with a five sixths (5/6) majority.
Article Four
1. All treaties brought up for consideration be passed with a majority of approval of the Royal Frenzy AND the approval of the King or Queen in the form of a signature.
2. An act of the Royal Frenzy shall be the lowest form of law and may be overridden by treaty, decree, or the constitution.
3. A Decree or Treaty shall have equal strength---while treaties override new decrees, no treaty may be passed that is not in accordance with an existing decree.
4. The Constitution shall be the supreme law of the land but no Constitutional amendment can be passed that contradicts an existing treaty, particularly deliberately.
5. Constitutional Amendments can be passed with a two thirds (2/3) majority of the Frenzy and approval of the King or Queen.
6. To officially declare war requires the approval of an Act of the Frenzy AND the signature of the King or Queen. The war may end with 2/3 majority in favor of ending in the Frenzy OR by Decree of the King or Queen.
Article Five
1. There will be a High Royal Court, lead by the High Royal Judge who is appointed to a life term by the King or Queen.
2. If there are at least 10 active citizens in Natopia, the High Royal Judge may nominate two additional judges.
3. If there are at least 20 active citizens in Natopia, the High Royal Judge may nominate a fourth and fifth judge.
4. Failure to nominate those judges in those events shall give the Regent this right.
5. Irregardless of who nominates them, the King or Queen must approve all nominations.
6. There shall always be an odd number of judges.
7. The King or Queen may remove all regular judges, but removing the High Royal Judge shall also require support from the majority of the royal frenzy.
8. The High Royal Court may issue a Judicial Review BASED ON A LEGAL SUIT BROUGHT BEFORE THEM declaring any action of the government to be against this constitution, and therefore voiding that action, excluding Constitutional Amendments. If this is a Decree this may be overturned by a majority of the Royal Frenzy. If this is an Act this may be overturned by the King or Queen.
Article Six
1. Natopia shall have an “open arms” policy towards citizenship. All people must be accepted in general; however when absolutely necessary the Royal Frenzy, with the exclusion of the individual in question, may revoke a person’s citizenship with a majority vote.
2. No Natopian law may oppress or deny from anyone within Natopia the rights of freedom of religion, life, property, and residence.
3. No Natopian law may oppress or deny citizens the rights of free speech, press, expression, or peaceful assembly.
4. Religious organizations may have full access to public institutions; they may not interfere with the normal operation of that institution or impose their religion on any person in the area. For instance no one may attempt to force their religion on the threat of public hostility; however general discussion of one’s religion is acceptable.
5. No Citizen shall be withheld any rights, freedoms, or liberties on account of race, creed, or sex. All Citizens over the age of thirteen (13) hold the right to vote or hold office. No government action may create unnecessary obstacles to discourage a Subject from voting.
6. Citizenship will not be denied on account of race, gender, color, sex, language, religion, sexual orientation, political or other opinion, national or social origin, property, birth or other status.
7. The Judge of any Court in Natopia will issue convictions and sentences without a jury. These convictions and sentences may be reviewed and overturned by Royal Frenzy.
8. Citizens must be given a trial that is to be completed as quickly as possible. Trials must be open to the general public for viewing. Citizens must not be asked to pay bail that is considered excessive in regard to their income.
9. Every Single (1) month a census will occur under the management of the Regent who will collect data from consecutive censuses. This Census will be in the form of an announcement on the forum if it is a ProBoards forum and will have similar sign of importance on any other forum. Citizens will simply be asked to indicate their presence of activity by confirming themselves in the census thread, and they will be given seven (7) days to do so. A running list of all citizens shall be kept by the Regent. Any citizen who does not indicate presence in one census shall be listed as non-present and the Regent will make as much of a reasonable stride as he or she possibly can to inform them of their status. If the citizen in question fails to show up in two (2) consecutive censuses status will again be changed to be inactive and for all purposes of this Constitution or other law they will not be counted in any counts as active citizens. Repeated strides of informing the individual shall be made. Should they once again fail to show up for the third census in a row their citizenship shall be considered invalid. A person may avoid censuses by informing the Regent of a Leave of Absence that may cover one or more censuses BEFOREHAND and the entire length of the leave must be told to him as well but Leave of Absence status shall be limited to 3 months.
Article Seven
1. All treaties of the Sovereign Natopian Empire and therefore the preceding Sovereign Natopian Kingdom and Sovereign Imperial Republic of Natopia shall remain in force.
2. All other laws that are not treaties shall not remain in force and shall be reexamined.
3. The Operating Rules of the Royal Frenzy shall continue to be in force to the best of their general ability until they can be modified to match the general law of this Constitution.
